Nyaoga lawyers yet to serve Raila with suit papers

Lawyers acting for Central Bank of Kenya chairman Mohammed Nyaoga have not yet served Cord leader Raila Odinga with the papers in a defamation case over the Eurobond saga.

Mr Odinga’s lawyer, Mr Paul Mwangi, told the Nation in Nairobi that he had not received anything by the close of business Tuesday.

“I have been waiting the whole of today and yesterday, but I’m yet to see anybody. I was expecting them either yesterday or latest today,” said Mr Mwangi.

DEMANDING APOLOGY

Mr Nyaoga is demanding an apology or the withdrawal of the claims Mr Odinga made that linked him to the loss of Eurobond billions

The procedure requires that once a party files a suit in court, it proceeds to serve the respondents as fast as possible.

In the case filed at the High Court in Nairobi on Monday, by the law firm of Mohammed Muigai Advocates, Mr Nyaoga wants Mr Odinga to “forthwith and publicly make a full, suitable, complete and an unconditional withdrawal” of his claims.

Besides the apology, Mr Nyaoga is also seeking compensation and an order stopping Mr Odinga from causing any further publication of the same remarks.
