Ex-President Moi Dragged To Court Over 25,000-Acre Land In Eldoret

Former president Daniel Moi has found himself in the centre of a land dispute between squatters and a former member of parliament in Eldoret.
800 squatters filed a petition in court to have the 25,000-acre land taken away from former nominated MP Mark Too and be given to them as Moi had apparently allocated it to them in 1998.
Daniel Moi, on Friday, December 4, denied claims and has threatened to sue anyone who will continue with the allegations.
“The land was previously owned by Lonhro Agri-Business East Africa Limited and there was no way I could have given out private property to the squatters as they claim. I am cautioning those maligning my name through these allegations that I will sue them,” the former president as quoted by The Standard.
The squatters, through their lawyer William Arusei, now want the case referred to Chief Justice Willy Mutunga as they have been before seven judges since 2007 without bearing any fruits.
They want Commissioner of Lands, Chief Registrar of Title Deeds, Director of Land Adjudication and Settlement, Director of Survey, District Land Officer (Uasin Gishu), Lonrho Agribusiness, Mark Too, David Korir, Highland Surveyors and Kennedy Kubasu to be held culpable for the purported irregular change of ownership of the land near Eldoret International Airport.
The case is set to be heard before Lady Justice Cecilia Githua on December 18.
A similar case was between Kamae squatters and Kenyatta University whereby the squatters refused to move out of a 70-acre piece of land said to be belonging to the university.
They claimed that Moi had given them the land in November 2001 during political rally in Korogocho.
Five groups of squatters have also been fighting over the ownership of 420-acre Kamiti/Anmer land at Muoroto with all of them claiming that Moi allocated them the land in 1996.
According to the law, a person can claim ownership to a piece of land if he/she has openly lived on the land without permission from the title owner and without force or coercion consistently for more than 12 years.
