Deputy President William Ruto’s younger brother has been dragged in to the National Youth Service (NYS) scandal.
Former devolution minister Anne Waiguru, in an affidavit presented to the Ethics and Anti-Corruption Commission (EACC), claimed that Ruto’s brother wanted a contract awarded to him irregularly.
“Kipchumba Murkomen (Elgeyo-Marakwet senator) visited my office in the company of a person he introduced as Luke Kimutai Samoei, the younger brother of DP Ruto. Samoei requested for business for his company by the name Equity Tech,” Anne Waiguru affidavit reads.Waiguru went on to state that Luke Samoei told her to be biased in giving his company “good work”.
She presented her affidavit to the EACC after Josephine Kabura, a key suspect in the KSh 791 million NYS scandal, named her as the mastermind of the alleged theft.
Anne Waiguru affidavit concluded that, based on analysis of the Directorate of Criminal Investigations (DCI) report, her accuser Josephine Kabura was only a from to a broader more powerful cartel with various beneficiaries from the political establishment.
Kabura had claimed that Waiguru helped her form companies that were later used in the NYS tenders. She also said Waiguru introduced her to about 10 people who would help her get the government contracts.
Anne Waiguru affidavit claimed that political actors, especially from Ruto’s URP party, attempted to intimidate her and a former top NYS official to stop investigations into the KSh 791 million scandal.
She said top politicians contacted her and former NYS deputy director general Adan Harakhe after she reported suspicious activities to DCI which opened investigations into the matter.
“On June 18, 2015, Aden Harakhe was texted and called by Aden Duale who advised him that he required political support and that leaders from his region came from URP,” she said.Duale warned Harakhe that he needed to be careful lest he is used and dumped by the other side of the Jubilee coalition (President Uhuru Kenyatta’s TNA), added Waiguru in paragraph 52 of her affidavit.
Waiguru said the calls for her impeachment started after she refused to budge to political pressure from top URP members like Senator Murkomen who told her that he represented clients whose funds had been frozen following the DCI probe.
“Senator Murkomen passed the message from his clients stating that I should tell DCI to drop the investigations and said I would face unspecified consequences if I did not adhere to these demands,” reads paragraph 58 of Anne Waiguru affidavit.She noted that Nandi Hills MP Alfred Keter, also a member of URP, commenced on several attempts to have her impeached by parliament after she failed to do as had been demanded by the politicians.
Waiguru indicated that involvement of URP in the NYS scandal did not stop with legislators. She said Ruto’s aide Farouk Kibet was also actively involved.
“During the time of DCI investigations there were constant communications between Ben Gethi (a suspect in the scandal) and Farouk Kibet with about 180 phone calls some lasting for hours between the two,” reads Anne Waiguru affidavit.National Assembly majority leader Aden Duale has denied Waiguru’s claims. Duale said Waiguru should prove that he got involved in the scandals or face him in court.
