CS Rotich dismisses Waiguru affidavit, calls it malicious faslsehood

– Rotich has now come out to deny the allegations and threatened to sue whoever publishes them

Treasury Cabinet Secretary Henry Rotich has hit back at former Devolution Cabinet Secretary Anne Waiguru after she implicated him in the ongoing National Youth Service (NYS) scandal in an affidavit sworn on Tuesday, February 23.
Rotich, through his lawyer Donald Kipkorir, has denied that he was involved in the stealing of more than KSh791 million from NYS coffers, instead terming the allegations malicious falsehoods.
The CS has also denied that he knows one Ben Gethi, a prime suspect in the ongoing investigations and that he does not own any company and was not in any way involved in any businesses with NYS.
“Without giving any credence to the veracity, truthfulness, genuineness and validity of the said memo, our client confirms that he does not know Mr Ben Gethi and he is not his agent in any way or at all,” the statement by the lawyer said.
Rotich has further threatened to sue ‘any person or party that published, publishes, or re-publishes the malicious falsehoods.’
In the explosive affidavit, Waiguru attached memos allegedly written to her by former acting Senior Director General Adan Harakhe revealing how former Principal Secretary Peter Mangiti introduced to him ‘an arrogant’ guy named Gethi whom he said was a friend to CS Rotich.

The memos also name Rotich as the powerful government official behind companies that demanded KSh 829 million from NYS.
Harakhe, in the memo dated June 3, 2015, told Waiguru that former principal secretary Peter Mangiti linked the companies to CS Rotich.
“He said ‘go slow on this thransaction, it will put you in trouble’… Those payments were for companies associated with CS Rotich who assisted us to get the funding and other wazees,” reads Harakhe memo attached to Waiguru affidavit.
According to Harakhe’s memo, Mangiti wanted the millions of shillings paid because Rotich had facilitated the wiring of KSh3.5 billion from Treasury to the NYS system.
Harakhe’s major concern was the manner in which 21 transactions were made in the Integrated Financial Management Information System (IFMIS).
He said that the transactions were made using his name without his approval and wanted the Directorate of Criminal Investigations (DCI) to help him know who did them. Mangiti heard that he had contacted DCI and told him that the matter would be solved internally.
Others implicated in the Waiguru affidavit are Majority Leader in the National Assembly and Garissa Township MP Aden Duale and assistant Majority Leader in the Senate and Elgeyo-Marakwet Senator Kipchumba Murkomen.
The two have since denied the allegations with Duale saying he is taking a sabbatical to deal with Waiguru.
Until the allegations surfaced, Duale was a strong defender of Waiguru, and was involved in the shooting down of impeachment motions drafted by MPs Mithika Linturi and Alfred Keter.

The accused have said that Waiguru wants to bring discord in the Jubilee coalition by playing URP (allied to DP William Ruto) against TNA (allied to President Uhuru Kenyatta).
